Raffle Official Rules - John Boos & Co

1. ELIGIBILITY

The Feeding America Raffle Ticket Sale is open only to legal residents of the lower (48) United States who are at least eighteen (18) years old at the time of entry. The raffle is subject to all applicable federal, state, provincial, municipal, territorial and local laws and regulations and is void where prohibited by law. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Raffle. Winning this package is contingent upon fulfilling all requirements set forth herein.

Employees, officers, and directors of Sponsor or any affiliate of Sponsor including any brand or any licensor or licensee of Sponsor, along with any immediate family members or individuals who share the same household, whether legally related or otherwise, ARE eligible to purchase raffle tickets or win the prize.

3. WINNER SELECTION

Raffle ticket purchases are necessary to enter or win. Void where prohibited by law. The winning raffle ticket we be selected at random and notified by John Boos & Co. There is no limit to the amount of raffle tickets a participant can purchase. Winner will be selected and contacted in a random drawing on Sept 5, 2023.

The Winner will be solely responsible for all federal, state, and/or local taxes, or for other fees or costs associated with the Prize or the entrant’s receipt of the Prize. The Winner may be required to provide Sponsor with a valid social security number, photo ID, or submit a W-9 before the prize is awarded for tax reporting purposes.

4. PRIZE

Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

5. ODDS

Actual odds of winning depend on the number of total raffle tickets purchased.

6. PUBLICITY, WAIVERS, DISCLAIMERS, AND RELEASES

By purchasing a raffle ticket, purchaser grants Sponsor the right to contact the purchaser via telephone or electronically.

Subject to applicable law, Winner irrevocably grants the Sponsor, and its licensees, successors, assigns, and sub-licensees, the right and permission to use his or her Entry to the Promotion (including any text, photographs, or other content), his or her name, address, and general and biographical information about the person including a photo for advertising, promotional, and/or publicity purposes in connection with this Promotion or other similar marketing initiatives of the Sponsor, in all forms of media and by all manners (now or hereafter known), worldwide, in perpetuity, and without any obligation to provide notice, royalties, or consideration beyond the awarding of the Prize to the winner, unless otherwise precluded by law.

By purchasing a raffle ticket, purchaser represents and warrants that he or she owns all intellectual property rights in the content including ownership of any copyright and that the content does not violate the rights to publicity, copyright, trademark or other rights of any other person or entity; that any third party featured in the content is over the age of 18 or is a person for whom you have the rights such as your children; and that you have the legal right to use such content in your Entry.

The Winner agrees that the Sponsor has permission and a license, worldwide, perpetually, on a royalty-free basis the right to repost or utilize all entries to the Promotion for its own marketing and promotional purposes in any manner Sponsor chooses.

By participating in this raffle, each entrant agrees to release, discharge, indemnify, and hold harmless Sponsor, its affiliates, and each of its respective licensees, brands, directors, officers, employees, agents, advisors, successors, and assigns from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines, or injuries (up to and including bodily injury and death) of any kind arising out of or related to i) the entrant’s participation in the Promotion; ii) any acceptance, possession, misuse, or use of the Prize; iii) any alleged violation of the rights of publicity or privacy, claims of defamation or portrayal in a false light; iv) any error or limitation, whether intentional or unintentional, that causes the entrant to be unable to fully participate in the Promotion; and v) any typographical, technical, electronic, human, or other error in the printing, offering, selection, operation, transcription of registration or entries, or announcement of any Promotion related activity and/or Prize.

Sponsor’s failure to enforce any term of these Rules will not constitute a waiver of that provision or bar the Sponsor from enforcing that term in the future. Winner waives any right it may have to claim ambiguity of these Rules or any advantage or effect on interpretation that may arise from any such claim.

7. GENERAL CONDITIONS

By purchasing a raffle ticket you agree to receive email notifications from John Boos & Co. and any brand companies that we are partnering with for the raffle. Our newsletter is to keep subscribers, customers, and visitors updated about new products, shopping cart reminders, news, announcements, events, or company information. John Boos & Co. reserves the right to cancel, suspend and/or modify the Raffle, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the raffle, as determined by John Boos & Co. in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be fraudulent, tampering with the entry process or the operation of the Raffle or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Raffle may be a violation of criminal and civil law, and, should such an attempt be made, John Boos & Co. reserves the right to seek damages from any such person to the fullest extent permitted by law.

John Boos & Co. does not take any portion of the proceeds and all entry ticket sales will go directly to Feeding America, a non-profit organization.

8. LIMITATIONS OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall John Boos & Co., our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
